Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Ascendra application, website, and related services (collectively, the "Service"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old (or the age of digital consent in your country) to use Ascendra. By using the Service you represent that you meet this requirement and that any information you provide is accurate.

2. Health disclaimer — not medical advice

Ascendra provides general fitness, nutrition, and wellness information for educational purposes only. It is not a medical device and does not provide medical advice, diagnosis, or treatment. AI-generated coach plans, calorie estimates, recovery suggestions, and analytics are informational only. Always consult a qualified healthcare professional before starting a new exercise or nutrition program, especially if you are pregnant, have a medical condition, or take medication. Stop and seek medical help if you experience pain, dizziness, or other symptoms during exercise.

3. Your account

  • You are responsible for your login credentials and all activity on your account.
  • Notify us immediately if you suspect unauthorized use.
  • One person per account. Do not share your account or impersonate others.

4. Subscriptions and billing

Ascendra offers a Free tier and paid subscription tiers (currently Basic and Pro). Paid tiers renew automatically until cancelled. Prices and features are shown at checkout and may change with notice.

  • Web billing (Stripe): managed from Settings → Subscription. Cancel any time; access continues until the end of the current billing period.
  • In-app purchase (Apple App Store / Google Play): billing, renewal, and refunds are handled by the store per its own terms. Manage or cancel in your device's store subscriptions.
  • Refunds: web subscriptions are non-refundable except where required by law. Store purchases follow the store's refund policy.
  • Free trials (if offered) convert to paid unless cancelled before the trial ends.

5. Acceptable use

You agree not to:

  • Use the Service for anything illegal, harmful, harassing, or deceptive.
  • Upload content that infringes intellectual property, privacy, or publicity rights.
  • Post harassing, hateful, sexual, or violent content in social features or chat.
  • Reverse engineer, scrape, or resell the Service, or misuse the AI features to generate prohibited content.
  • Attempt to access another user's account or bypass security controls.

We may remove content and suspend or terminate accounts that violate these Terms.

6. User content

You retain ownership of workouts, notes, photos, measurements, and messages you create ("User Content"). You grant Ascendra a limited, worldwide, non-exclusive license to host, process, display, and back up your User Content solely to operate the Service for you. When you share content with friends, trainers, or in social features, you authorize Ascendra to display it to those recipients.

7. AI features

The AI coach, meal scanner, weekly recap, and related features are powered by third-party AI models. Output may be inaccurate or incomplete and should not be relied on as medical, nutritional, or professional advice. You are responsible for reviewing AI suggestions before acting on them.

8. Third-party services

The Service integrates with Apple HealthKit, Google Health Connect, Bluetooth wearables, Stripe, and other third parties. Your use of those services is subject to their own terms and privacy policies. Ascendra is not responsible for third-party services.

9. Termination and account deletion

You may delete your account at any time from Settings → Data & privacy. Deletion permanently removes your workouts, meals, measurements, photos, chats, and profile from active systems within 30 days, excluding limited backups that are purged on their normal cycle. We may suspend or terminate accounts that violate these Terms or applicable law.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or produce specific fitness, weight, or health outcomes.

11. Limitation of liability

To the maximum extent permitted by law, Ascendra and its providers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim arising out of the Service is limited to the greater of the amount you paid us in the 12 months before the claim or USD 50.

12. Changes to the Service and Terms

We may modify the Service and these Terms from time to time. Material changes will be announced in the app or by email. Continued use after changes take effect constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of your country of residence to the extent required by mandatory local consumer-protection law; otherwise by the laws applicable at Ascendra's principal place of business, without regard to conflict of laws principles. Disputes will be resolved in the competent courts of that jurisdiction, subject to any mandatory consumer forum.
